1. Acceptance of Terms
By creating an account and using EZ Estimates, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the application.
2. Description of Service
EZ Estimates is a contractor estimating application that provides:
- AI-powered job site photo analysis for estimate generation
- Customer management and organization
- Estimate creation with itemized line items
- Cost calculation including materials, labor, markup, and tax
- AI-powered in-app help and support
- Estimate sharing and printing capabilities
3. User Accounts
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and current information
- Notifying us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these terms.
4. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Upload malicious content, viruses, or harmful code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the service
- Use automated tools to scrape or collect data from the service
- Impersonate another person or entity
- Use the service to send spam or unsolicited messages
5. AI-Generated Content
EZ Estimates uses AI technology to analyze photos and generate estimates. Please note:
- AI-generated estimates are suggestions and should be reviewed for accuracy
- You are responsible for verifying all estimates before sharing with customers
- We do not guarantee the accuracy of AI-generated line items or pricing
- AI analysis is provided as a tool to assist, not replace, professional judgment
6. Your Data
You retain ownership of all data you input into EZ Estimates, including customer information and estimates. By using the service, you grant us a limited license to process your data solely for providing the service.
You are responsible for ensuring you have appropriate consent to store customer information in the application.
7. Pricing and Payment
EZ Estimates offers subscription plans as displayed in the application. Current plans include Standard and Pro tiers billed monthly. By subscribing, you authorize recurring charges to your payment method.
Cancellations
You may cancel your subscription at any time through the app. Cancellations take effect at the end of the current billing period. You will retain access to paid features until the period ends.
Refunds
Subscription fees are non-refundable except where required by law. No refunds are issued for partial billing periods. Users seeking a refund exception may contact support@ezestimates.org and requests will be reviewed on a case-by-case basis.
We reserve the right to modify pricing with reasonable notice to users.
8. Intellectual Property
The EZ Estimates application, including its design, features, and content (excluding your data), is owned by EZ Estimates and protected by intellectual property laws. You may not copy, modify, or distribute any part of the application without our written consent.
9. Limitation of Liability
To the maximum extent permitted by law:
- EZ Estimates is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
- We are not responsible for losses resulting from reliance on AI-generated estimates
10. Indemnification
You agree to indemnify and hold EZ Estimates harmless from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of any rights of another party.
11. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will endeavor to provide advance notice of planned downtime.
12. Termination
You may stop using EZ Estimates at any time. We may terminate or suspend your access if you violate these terms. Upon termination, your right to use the service ceases, though we may retain data as required by law.
13. Changes to Terms
We may update these Terms of Service from time to time. Continued use of the service after changes constitutes acceptance of the updated terms. We will notify users of significant changes.
14. Governing Law
These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or the service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
